Terms of Service

1. Acceptance

By creating an account or using Open Notifier (“Service”), you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. By using it, you represent that you meet this requirement.

3. Your Account

You are responsible for maintaining the confidentiality of your API keys and credentials. You are responsible for all activity that occurs under your account. Notify us immediately at hello@open-notifier.io if you suspect unauthorized access.

4. Acceptable Use

You agree not to use the Service to:

• Send spam, unsolicited messages, or abusive content.
• Violate any applicable law or regulation.
• Attempt to reverse-engineer, hack, or disrupt the Service or its infrastructure.
• Resell or white-label the Service without our written consent.
• Transmit malware, viruses, or any harmful code.

We reserve the full right to suspend, restrict, or permanently ban any account at our sole discretion if we determine — at any time — that the account is being misused, violating these Terms, causing harm to the Service or other users, or engaging in any activity we consider inappropriate or abusive. No prior notice is required. Banned accounts are not entitled to a refund.

5. Free Tier & Pro Plan

The Free tier includes Push and Telegram channels at no cost. The Pro plan (when available) unlocks additional channels at a price announced before launch. We reserve the full right to update, change, or restructure plans, pricing, and included features at any time. Pricing changes will be communicated with at least 7 days notice to existing subscribers. Waitlist placement does not guarantee a fixed price or specific feature set.

6. Service Availability

We provide the Service on an “as-is” and “as-available” basis. We do not guarantee uninterrupted or error-free operation. We are not liable for missed or delayed notifications caused by third-party services (Firebase, Telegram, etc.), network issues, or circumstances beyond our control.

7. Disclaimer of Warranties

To the maximum extent permitted by law, Open Notifier disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. You use the Service at your own risk.

8. Limitation of Liability

To the maximum extent permitted by law, Open Notifier and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Service — even if we have been advised of the possibility of such damages. Our total liability for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.

9. Intellectual Property

The Service, its branding, and its underlying code (where not open-source) are owned by Open Notifier. You retain ownership of all content you send through the API. You grant us a limited license to process and transmit that content solely to deliver the Service.

10. Termination

You may delete your account at any time by emailing hello@open-notifier.io. We may suspend or terminate your account for violations of these Terms or for any other reason with reasonable notice. Upon termination, your data will be deleted within 30 days.

11. Governing Law

These Terms are governed by the laws of India. Any disputes shall be resolved in the courts of India.

12. Changes to These Terms

We may update these Terms. We will notify you via email or a dashboard notice at least 7 days before material changes take effect. Continued use after that period constitutes acceptance.
